1. Paid Services
1.1 To gain full access to TallyFlex services, we offer a premium version for a fixed subscription fee. Your premium membership includes access to features like unlimited Students, Sessions, and Insights about the data collected. Unless You specifically allow it, the data you collect will not be shared with other TallyFlex members.
1.2 TallyFlex’s only responsibility is to collect and provide limited insight into the data collected. Such insights must not be considered as professional advice. The ease of data recording and insights are only to assist You in collecting data. Always consult with specialists before making any decision from your data or insights provided by TallyFlex.
You shall not store or share any data collected or any other information in the Application: (i) unless you are authorized by all related parties to do so; (ii) that would result in you or us breaching any law, rule, regulation, code or other legal obligation; (iii) that is or could reasonably be considered in our sole discretion: (1) to be obscene, defamatory, disparaging, indecent, offensive, threatening or inciting racial hatred, discriminatory, blasphemous, in breach of confidence or privacy or objectionable in any way; (2) that would harm TallyFlex’s reputation, the Application or its features in any way; (3) that could result in infringement of the intellectual property or other proprietary rights of any person, or (4) is expected to subject us to any obligations legal or monetary.
1.3 The responsibility of securing your Account and password is Yours, as well as and restricting access to your password and your devices when using the Application. Activities originating from Your Account or devices are Your responsibility. You assume all risks of unauthorized access to the user data and any other information you provide to us.
2. Accounts and Paid Subscription Packages
2.1 TallyFlex can offer certain features and services based on a subscription fee or other fees. These are considered Premium Services. By choosing to enroll in Premium Services or make purchases within the Application via third-party stores (like Google Play or iTunes), any applicable fees or charges will be processed by these stores according to their terms and conditions for your corresponding purchase.
2.2 When buying an auto-recurring subscription through in-app purchase, you will be billed periodically based on the terms You selected (monthly or yearly until you decide to cancel. In the event you don’t want your subscription to renew or decide to change or terminate your subscription, you must do so by logging into your Account and follow the instructions to make the desired modifications. Deleting the Application from your devices or deleting your Account will not cancel Your subscription. You must cancel your subscription as outlined in these Terms before deleting your Account or Application.
2.3 You have absolute rights to terminate your subscription at any point. Canceling or terminating your subscription must be done via your Apple or Google Account or via the TallyFlex website (wherever you subscribed initially). If canceled, your subscription will remain valid, and You will maintain your access to the Application until the relevant billing cycle conclude. Once this time expires, your subscription access to Premium Services will cease.
2.4 If you choose to cancel your subscription, TallyFlex reserves the right to delete all data stored under your Account when the expiration date passes.
3. Billing Cycle and Payment
3.1 The membership fee for the Premium Services, the purchase price of In-App Products, and any other charges you may incur in connection with your use of the service, such as sales tax, VAT, and any additional transaction fees, will be charged to you via your Apple or Google Account or via the third-party payment gateway accessible through our website or desktop application (however you choose to subscribe).
3.2 You can select the length of Your billing cycle when signing up for a subscription. TallyFlex offers monthly and annual memberships, which will determine when You will be charged.
3.3 In some cases, like if your chosen payment method has not settled successfully, the payment date may vary.
3.4 Payments will either be to TallyFlex directly or to a third-party payment processor. In the event of non-payment, TallyFlex will terminate Your membership.
3.5 TallyFlex or its billing agents will stop all further charges if a member exercises their cancellation rights. Premium Services will continue to be accessible until the billing cycle expires. The expiration date is fixed and set when You sign up for Your subscription.
3.6 All subscription fees are non-refundable.
3.7 TallyFlex reserves the right to modify the subscription fee at any time in the future. However, any price changes will apply to subsequent billing cycles only.
3.8 TallyFlex may, from time to time, offer new members a “free trial” period where TallyFlex will wave the subscription fees for some time.
